DESCRIPTION:In my latest book\, I explored the many ways families are aff
ected by the interrelations between globalization and borders\, and the
key role of the law in shaping these globordered families’ creation\, pr
actices\, and breakdown. The Covid-19 crisis provides a fascinating oppo
rtunity to revisit these families. In my talk\, I will present findings
from my current study (funded by the ISF)\, on struggles of different ty
pes of globordered families against Covid-regulation – binational couple
s\; families created by transnational surrogacy\; multi-generational fam
ilies separated by a national border\; and\, families assisted by a migr
ant worker for the care of an elder parent and the migrants’ left behind
families. These case studies highlight how common and important\, yet l
egally vulnerable\, globordered families are\, and how resilient and leg
ally creative many of these families members are. Furthermore\, their st
ruggles during the pandemic\, provide valuable lessons regarding the way
the law should be shaped so to allow globordered familiality to thrive.
I would argue that at the heart of the dramatic legal change needed\, s
hould be a new broader understanding of “the family”\, and a new spatial
and temporal understating of “the right to family life”.\n\nDaphna Hack
er is a legal scholar and a sociologist\, and is a full professor at the
Law Faculty and the Women and Gender Studies Program\, Tel Aviv Univers
ity. Her socio-legal research focus on the intersection of law\, familie
s and gender and provide empirical as well as normative insights in rela
tion to post-divorce parental arrangements\, inheritance conflicts\, fil
ial piety towards elder parents\, and transnational families. Prof. Hack
er has published numerous articles in leading legal and socio-legal jour
nals and is the author of three books. Her latest\, published by Cambrid
ge University Press in 2017\, is titled "Legalized Families in the Era o
f Bordered Globalization"\, and wan the best book award by the Law & Soc
iety Association. Prof. Hacker was recently elected to serve as a member
of The International Committee on the Elimination of Discrimination Aga
inst Women (CEDAW) for the term 2023-2026.
