The paper aims to see whether the criminal law is effective to counteract the deliberate breach of regulatory requirements in the recent PIP breast implant scandal in France. The paper will seek to draw out lessons about regulatory failure to improve control systems, and to find ways to ensure that victims get support and compensation for the harm caused to their bodies as a result of the breach even where there is no evidence of risk to health.
