Tim McNamara coined the phrase ‘Regimes of Shibboleth Consciousness’ in relation the ‘undecideability’ of the individual in the face of judgement. He drew Jacques Derrida’s work on the shibboleth which refers to a particular identification of an ‘enemy’ through a linguistic judgement and a perceived connection to a social group. Derrida drew on his own personal experiences of anti-semitism to build on Paul Celan’s work in this area and he was acutely aware that the ‘shibboleth’ was relevant to marginalised groups more broadly. In this respect, I use the ‘shibboleth’ to analyse the role of countering violent-extremism in relation to Muslims and relate it to work on security. I conclude that the judgments, based in part on language, have ramifications for the types of legal pathways to create differing forms of justice.
